Land Use Change

Planning a new building or a new use on your property? Contact the Benton County Environmental Health and Land Use Department to find out whether you need to submit a land use change application or request a farm exemption.

Land Use Change

The entire unincorporated area of Benton County is designated as an Agricultural Land Use District.  Any new non-agricultural use within this district must receive approval from the Board of Supervisors prior to commencement.

To initiate the permission approval process for a new non-agricultural use, submit the completed application, building site location sketch, and associated non-refundable application fee ($500) to the Environmental Health and Land Use Department.

The process consists of the following: 

  • The Board of Supervisors will set a date for a public hearing concerning the request
  • Department staff will formulate a technical review report
  • Landowners within five hundred feet of the requested property boundary lines will be notified by mail of the request and the public hearing
  • Notice of the public hearing will be published in the official newspapers of Benton County
  • The Board of Supervisors will conduct a public hearing to consider the request and will make its decision to approve or deny the request based upon information presented and reviewed

Land Use Change Application

Farm Exemption

A farm is defined as an area comprising twenty-one (21) or more contiguous acres which is used in the commercial production of farm products.  Farms are exempt from the requirements of the Agricultural Land Preservation Ordinance.  Farm houses and other farm structures do not need to submit a land use change application and should rather submit a farm exemption application.

This exemption does not apply to any structure, buildings, dam obstruction, deposits or excavation in or on the floodplain of any river or stream.
