Subdivisions
Subdivision Approval Process
The subdivision approval process begins with the submission of 10 copies of the preliminary plat and a $500 filing fee to the Environmental Health & Land Use Department.
Department staff will review the preliminary plat for compliance with the Subdivision Ordinance before presenting it to the Board of Supervisors for approval. Approval of the preliminary plat is valid for one year, during which time the final plat must be approved.
After preliminary approval, the subdivider must submit 10 copies of the final plat along with a $250 fee per lot to the Environmental Health & Land Use Department. Department staff will review the final plat for compliance with the Subdivision Ordinance prior to submitting it to the Board of Supervisors for approval.
Once the Board of Supervisors approves the final plat, the plat and all required attachments must be recorded within 120 days.
No building may begin, and no structure may be moved onto any lot where a subdivision is required, until the final plat has been approved and recorded.

Benton County Code of Ordinances
Subdivision Agricultural Exception
Parcels that have been in continuous non-residential agricultural use since January 1, 2001, and that continue to be used solely for non-residential agricultural purposes, are exempt from subdivision requirements.
If the non-residential agricultural use ceases, the exemption ends. No permits will be issued until the subdivision complies with the requirements of the Subdivision Ordinance.
To request an agricultural exception, submit an Agricultural Exception Request to the Environmental Health & Land Use Department. Department staff will review the request and issue a letter of approval, which is required in order to record a plat for the applicable parcel.
